The Graves Amendment established that a non-negligent rental company of a car is not liable for damages resulting from the operation or use of the vehicle during the lease term. The Graves Amendment will not protect a rental car company who failed to properly maintain a vehicle from liability for an accident caused by mechanical failure. If a company rents a recalled car, it may be liable for an injury caused by the failure. A couple of years ago , consumer groups were pushing the Federal Trade Commission to force rental car companies to address safety recalls made by car manufacturers after a failure to fix a defect subject to a recall led to a fatal crash.

at Boston City Hall much to the chagrin of City Councilor Charles Yancey. According to Yancey, Boston City Councilor Sal LaMattina, chair of the Committee of City, Neighborhood Services and Veterans Affairs, cancelled the hearing, originally scheduled for Sept. 16, because Brian Swett, chief of the citys Environmental and Energy Services Cabinet, would not be able to attend the hearing. Yancey said he was extremely displeased when he was told of the meetings cancellation. I am profoundly disappointed with Councilor LaMattinas decision to cancel the hearing that to learn more he had originally agreed to hold. Yancey pointed out that Bryan Glascock, commissioner of the citys Inspectional Services Department, could have represented Swett at the hearing.
